How to Apply for Fee Waivers

U.S. Citizenship and Immigration Services (USCIS) use application and filing fees to fund its services. When a fee is successfully waived, you are able to file forms for free while the cost is transferred to other applicants.

When applying for a fee waiver, applicants must use a form or offer a written statement to USCIS. USCIS determines eligibility through the use of methods which are discussed on specific forms. Additional documentation may be required when applying for a fee waiver.

Steps taken by the USCIS in reviewing requests are:

1.      Determining whether or not an applicant is receiving a “means-tested” benefit.

2.      Determining the applicant’s household income.

3.      Considering any special financial hardship that the applicant is suffering from.

Only certain forms are eligible for a fee waiver.  In addition, some forms are fee exempt. Lastly, special cases apply to those requesting fee waivers for Initial Temporary Protected Status (TPS) registration.
